Since January 9, 2016, ODR Regulation No. 524/2013 (EU) stipulates that online retailers must clearly link their websites to the “online dispute resolution platform” of the EU Commission (OS platform for short).
The OS or ODR Regulation is directly enforceable in all EU Member States and requires providers who distribute goods or services through their website to consumers (“B2C”) to provide “accessible access” through a link to the OS platform, The OS platform is operated by the European Commission and can be accessed at http://ec.europa.eu/odr/
.Now there are more and more court decisions that require an active, so actually clickable link on the website of the online retailer and the lack of active and functional linking as anticompetitive. In order to avoid warnings, we therefore recommend that all online retailers provide information about this OS platform and, in particular, to use an active link which is easily accessible to the consumer and which leads to the OS platform in one click, preferably in the imprint of the website.
